Robert Hogeboom is a senior capital partner with the National Law Firm Hinshaw & Culbertson LLP. He is the senior regulatory lawyer in the firm. He was President of the Federation of Regulatory Counsel from 2000 – 2001. His regulatory practice expands 40 years. For 38 years he was a member of Barger & Wolen LLP a renowned California insurance law firm started by Richards Barger who was appointed Insurance Commissioner by then Governor Ronald Reagan in 1968 and who served as President of the National Association of Insurance Commissioners in 1972. Barger & Wolen was founded in 1976 and merged with Hinshaw & Culbertson in October 2014. Mr. Hogeboom devotes his practice exclusively to insurance regulatory, corporate, legislation/adoption of regulations and administrative matters principally before the California Department of Insurance (CDI) and the courts. Mr. Hogeboom represents numerous insurer and producer clients in regulatory and administrative matters including formation and mergers of insurers, certificates of authority, market conduct matters including claims, rating and consumer complaint issues. He has handled more than 50 hearings involving CDI enforcement actions against insurers and producers including rate hearings, market conduct actions and disciplinary proceedings. In addition, Mr. Hogeboom serves as outside special counsel to several producer trade associations and serves as the firm’s liaison to the Association of California Insurance Companies and special counsel to the Pacific Association of Domestic Insurance Companies. Mr. Hogeboom has been involved in a number of important cases that affect the regulation of the insurance industry including: i) representation of 63 insurers in connection the implementation of prior approval of rates in California following the 1988 initiative which resulted in California becoming a prior approval rating state; ii) between 2000-2008 Mr. Hogeboom was involved on behalf of two insurance producer trade associations in matters related to broker fees, insurer compensation to producers and fiduciary issues between insurers, producers and consumers. Mr. Hogeboom served on Insurance Commissioner Poizner’s insurance task force and headed the Commissioner’s sub-committee to establish new legislation to clarify the difference between an agent and broker and compensation associated thereto. In 2010 the Western Insurance Agents Association honored Mr. Hogeboom as Insurance Attorney of the decade (2000-2010); iii) over the last four years Mr. Hogeboom represented a large national health insurer in a California market conduct claims administrative matter in which the CDI was alleging claims violations under regulations which he alleged were unlawful as they exceeded the scope of the statutory violations. After three separate rulings supporting the insurer, the CDI dismissed that action; iv) recently Mr. Hogeboom authored an Amicus Brief before the California Supreme Court in a similar action involving CDI newly issued regulations governing the method for estimating replacement costs on homeowner’s insurers under the Unfair Practices Act in the insurance code.
